Article 2 – Definitions

  • Entrepreneur: Megalampen.nl, trading under Eijk Commerce

  • Consumer: natural person who is not acting in the exercise of a profession or business

  • Agreement: distance agreement between entrepreneur and consumer

Article 3 – Applicability

These general terms and conditions apply to every offer from Megalampen.nl and to every distance agreement between the entrepreneur and the consumer.

Deviations are only valid if agreed in writing.

Article 4 – The offer

  • The offer is without obligation

  • Obvious errors or mistakes do not bind Megalampen.nl

  • Images and specifications may differ and are indicative

Article 5 – The agreement

  • The agreement is concluded after acceptance of the offer and successful payment

  • The consumer receives an order confirmation by e-mail

  • Megalampen.nl reserves the right to refuse orders if fraud is suspected

Article 6 – Prices and payment

  • All prices include VAT

  • Any additional costs will be clearly stated in advance

  • Payment must be made via the offered payment methods

Article 7 – Delivery and execution

  • Megalampen.nl will process orders with care

  • Delivery takes place at the specified address

  • The maximum delivery time is 30 days

  • If this period is exceeded, the consumer has the right to dissolve the agreement

  • The risk of damage or loss lies with Megalampen.nl until delivery

Article 8 – Right of withdrawal

The consumer has the right to withdraw from the agreement within 14 days after receipt without giving reasons.

Megalampen.nl also offers a voluntary return period of 30 days, during which the consumer can return the product.

Consumer obligations:

  • Handle product and packaging with care

  • Only use for assessing the product

Return conditions:

  • Product must be returned in its original condition (if possible)

Return costs:

  • Return costs are for the consumer's account, unless stated otherwise

Refund:

  • Within 14 days after withdrawal notification

  • Refund may be delayed until the product has been received or proof of return has been provided

Article 9 – Exclusion of the right of withdrawal

The right of withdrawal is excluded for:

  • Custom-made products

  • Products with a limited shelf life

  • Hygienically sealed products after opening

Article 10 – Warranty and conformity

  • Products comply with the agreement and legal requirements

  • The consumer is entitled to a legal warranty

  • Defects must be reported within a reasonable period

Article 11 – Complaints procedure

Article 12 – Liability

  • Megalampen.nl is not liable for indirect damage, consequential damage or loss of profit

  • Liability is limited to the amount of the order

  • Nothing excludes legal liability in case of intent or gross negligence

Article 13 – Force majeure

Megalampen.nl is not liable for delays or shortcomings as a result of force majeure, including:

  • malfunctions

  • transport problems

  • external supplier problems

Article 14 – Retention of title

Products remain the property of Megalampen.nl until full payment has been received.

Article 15 – Privacy

Personal data will be processed in accordance with Megalampen.nl's privacy and cookie policy.

Article 16 – Disputes

  • Dutch law applies

  • Disputes can be submitted via the European ODR platform

Article 17 – Changes

Megalampen.nl reserves the right to change these terms and conditions. The most current version is available on the website.
